Introduction

The following terms and conditions govern the use of services provided by Clipping Path Design (CPD) (“We”, “Us”, “Our”) through our website, https://clippingpathdesign.com/ (“the Site”). These services include but are not limited to clipping path generation, color mask generation, retouching, and other graphic design services (“Services”) provided to the purchaser (“You”, “Your”).

We reserve the right to amend these terms and conditions at our discretion. Any amendments will become effective seven (7) days after they are posted on the Site.

By browsing the Site, creating an account, or submitting an order, you agree to be bound by these terms. If you do not agree with any part of these terms, you must refrain from using our Services.

The Service

Upon purchasing our services, you agree to the following:

  1. Order Submission: You will use the tools provided on the Site to submit a graphic file (up to 10GB, or as agreed) and a detailed description of the Services required, along with any specific instructions. This constitutes your order (“the Order”).
  2. Order Acceptance: Upon receipt, we will review your Order for compliance and capacity. We will notify you by email to confirm acceptance and the agreed price and payment terms.
  3. Service Delivery: After confirming your Order, we will use industry-standard tools to deliver the services as specified. You will be notified by email when your Order is completed, and the results will be available for download.
  4. Payment Terms: Unless payment is made in advance, we will invoice you upon delivery of the Services. Payment is due within seven (7) days from the invoice date or as otherwise agreed.
  5. Cancellation: Orders can be canceled before acceptance. Once the Order is accepted, cancellation is not possible.
  6. Delivery Times: Estimated delivery times are given, but we are not liable for delays beyond our control.

Warranty and Liability

  1. Warranties: We guarantee that the services provided will meet the specifications of your Order. If any defects are found, we will repeat the Services at no additional cost, provided the defect is due to our error.
  2. Limitation of Liability: Our maximum liability for any Order will not exceed the price paid for that Order. We are not liable for any indirect or consequential damages, including loss of profit or data.
  3. Claims: Any claims regarding the quality of Services must be submitted within three (3) days of delivery. After this period, the Services will be deemed accepted.
  4. Website Availability: We aim to ensure the Site is always available, but cannot guarantee continuous or error-free operation. We accept no liability for downtime or technical issues.

Intellectual Property

  1. User’s Content: You represent that you have the right to submit all content for processing. You agree to indemnify CPD for any third-party claims relating to the content you submit.
  2. CPD’s Content: All trademarks, logos, and content provided by CPD are owned by us and cannot be used without prior written consent.

Privacy

  1. Personal Information: We collect personal information, including your name and email address, to fulfill your Orders and enhance your experience. Your data will not be sold or shared with third parties except as required to fulfill Orders or as otherwise disclosed in our Privacy Policy.
  2. Opt-out: If you prefer not to receive communication from us, you may opt-out by contacting us.

  4. Governing Law: These terms are governed by the laws of Bangladesh, and disputes will be resolved in the courts of Bangladesh.
